General Terms of Sale

1. Introduction

These General Terms of Sale (hereinafter "GTS") govern the relationship between BemyGirl (hereinafter "we" or "our") and any individual (hereinafter "you" or "the user") who subscribes to our Premium service on the BemyGirl website (hereinafter "the Site").

2. Acceptance of GTS

By subscribing to Premium access, you unconditionally accept these GTS. If you do not accept these GTS, you should not subscribe to Premium access.

3. Service Description

Premium access entitles you to additional and exclusive features on the Site, which may vary from time to time at our discretion. These features may include access to exclusive content, photos and videos, BMG Messenger, and other benefits.

4. Price and Payment

The price of Premium access is stated on the Site. We reserve the right to change the price at any time. Payment must be made online by credit card. We use secure payment services to process transactions.

5. Non-refundable

Premium access is non-refundable, except as provided by law.

6. Personal Use

Premium access is personal and non-transferable. You are not allowed to share, sell, or transfer your Premium access to another person. Any violation of this clause will result in the immediate termination of your Premium access, without refund.

7. Intellectual Property

The entire content accessible via the Premium subscription is protected by copyright and other intellectual property laws, in accordance with the Swiss Federal Act on Copyright and Related Rights (FACRR) and applicable international treaties. This content includes, but is not limited to, texts, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software.

Unless expressly and in writing authorized by us, you are not allowed to copy, distribute, broadcast, sell, license, or exploit for commercial purposes this content. Any unauthorized use of the content may constitute a violation of copyright and intellectual property laws, and may result in civil and/or criminal sanctions.

Under articles 67 and following of the FACRR, copyright infringement can lead to a prison sentence of up to five years or a monetary fine. In addition, we reserve the right to undertake civil actions to obtain damages and/or the cessation of unauthorized use of our content.

Please note that we take the protection of our intellectual property very seriously. We encourage our users to respect these rights and to use our content in a legal and ethical manner.

8. Privacy

We respect your privacy. All information you provide to us when subscribing to Premium access is treated in accordance with our Privacy Policy.

9. Applicable Law and Jurisdiction

These GTS are governed by Swiss law. Any dispute relating to their interpretation or execution will be under the exclusive jurisdiction of the courts of Geneva, Switzerland.

10. Modifications to the GTS

We reserve the right to modify these GTS at any time. You will be informed of any significant changes. By continuing to use Premium access after these changes have been published, you accept the amended GTS.
